Delhi High Court Detention Case : The Delhi High Court on Wednesday heard a petition challenging orders related to the continued detention of Saurav Das and Ashutosh Ranka. During the hearing, the court repeatedly questioned why the petitioners had approached the High Court directly under Article 226 of the Constitution when statutory appeals and other legal remedies were available. Following the court's observations, advocate Abhik Chimni, appearing for the petitioners, decided to withdraw the petition. The matter concerns orders passed by a Special Executive Magistrate on October 14 and October 19.
Court Questions Failure to Use Appeal Options
During the hearing, the High Court asked why the petitioners had not challenged the magistrate's orders before the District Magistrate or the appropriate appellate authority, where such remedies were available. The court observed that proceedings under Article 226 primarily allow it to examine whether the prescribed legal procedure has been followed. Reassessing facts and evidence, it noted, is generally the responsibility of an appellate court. Although the petitioners' counsel argued that the orders extending detention and rejecting sureties were arbitrary, the court emphasised the availability of alternative legal remedies.
Dispute Over Alleged Breach of Bond Conditions
The petitioners' counsel argued that his clients had been compelled to execute bonds and that the October 19 order had been passed without following the proper procedure. Referring to Section 135 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), he submitted that concrete grounds were necessary to justify preventive action based on the apprehension of a breach of peace. The High Court, however, noted that an alleged violation of previously executed bonds had been reported and that the magistrate had made the decision based on the assessment before him. The court questioned whether it would be appropriate to review that assessment at this stage.
Debate Over Repeated Rejection of Sureties
During the proceedings, advocate Abhik Chimni claimed that the sureties presented on behalf of the petitioners had been rejected several times. He expressed concern that if the magistrate's court rejected the sureties again after the petition was withdrawn, the petitioners might have to approach the High Court once more. The court responded that the rejection of sureties could be challenged separately through the appropriate legal process. It also questioned why the petitioners were not first using the available remedies when they could present fresh sureties before the magistrate.
Questions Over Protest and Breaking Barricades
The High Court also raised questions about the events surrounding a protest at Jantar Mantar and the alleged breaking of barricades by demonstrators attempting to move forward. The court observed that barricades are installed to maintain security and public order. Breaking through them could escalate tensions and encourage others to gather at the location, potentially creating further law-and-order concerns. Referring to incidents reported on October 10 and October 13, the court considered the alleged breach of previously executed bonds and the possibility of a disturbance to public peace. It also questioned whether the petitioners could benefit from any legal protection available to them in the relevant proceedings.
What Are the Next Legal Options?
During the hearing, the High Court emphasised that the petitioners should consider the alternative legal remedies available to them. It also questioned the need to file an urgent petition before the High Court when proceedings were scheduled before the Special Executive Magistrate. The petition was ultimately withdrawn by the petitioners. Questions concerning their detention and the rejection of sureties will now have to be pursued through the applicable legal procedures. The proceedings highlight the High Court's emphasis on using available statutory remedies before seeking direct intervention under Article 226 of the Constitution.
